The Hearing Space takes the privacy of personal data seriously and we are committed to the security of, and transparency around, how we handle personal data. This information is intended to inform you about the types of personal data we process, how we collect it and our legal bases for doing so. It also informs you of your rights in relation to personal data we may hold about you and how you can contact us should you have any queries or concerns about this.

About Us

‘The Hearing Space or ‘we’ (or ‘our’ or ‘us’) refers to the Hearing Space Ltd. Our registered address is Lister House, Lister Hill, Leeds, LS18 5AZ.

For UK and European data privacy purposes when we act as a controller of personal data we do so either as The Hearing Space Ltd (registered in England & Wales number 11723066).

How we collect your data

We obtain personal data only directly; for example, directly from our clients when they engage with us for goods and services and directly from our suppliers and other business partners in the course of normal commercial interactions to procure goods and services from them.

We do not obtain personal data indirectly from third parties.

Clients

Personal data that we collect from you directly is used only in the course of delivering goods and services to you. We will only collect data from you that is relevant to the service, or the goods, being delivered. This may include some or all of the following:

  • Identification and contact data (name, address, email, telephone number, etc)
  • Other personal details that may be considered relevant during the course of our consultations and audiological assessments with you
  • Physical health data relevant to audiological assessment and, rarely, mental health data only if considered relevant to audiological assessment
  • Physical health data that we generate with you (audiograms and other records of hearing tests and assessments)
  • Financial information (bank details, card payment details etc) for the payment of good and services delivered

We will add your contact data to our mailing list unless you tell us not to (see ‘Marketing’ below).

We consider our lawful basis for processing the types of personal data above to be the fulfilment of our contract with you to deliver goods and/or services to you. If you have given us your email address, we will use that to communicate with you specifically in relation to matters to do with you as a client. If you agree we may send marketing information to you by email (see ‘Marketing’ below).

Your health data

To provide and maintain an environment where all information and disclosures regarding patients and patient care is kept confidential and within legal parameters at all times. Those procedures will comply with The Data Protection Act 1998, Access to Medical Records Act 1990 and the EU General Data Protection Regulation (GDPR) (effective from 25/05/2018).

We process your data within our Clinic Management Systems in order to provide effective services to you. Your data is managed securely and in accordance with GDPR rules. The system we use is:

How long do we keep your data?

We will retain your data for as long as is necessary having regard to the purpose for which it was collected and in accordance with all applicable UK laws. Thereafter we will only retain your data if we have a continuing legal requirement to do so. You also have the right, under UK Data Protection legislation, to formally request that you wish your data to be removed from our systems (see the end of this notice for further details).

Marketing

We may contact you to keep you informed about our services and to give you news and updates about what is going on at our practice. We will use your email address and occasionally your postal address. We have a legitimate interest in marketing our services as a normal and expected activity in running a business, and we make every effort to do this in the most informative way and with the minimum amount of intrusion. You have the right to opt out of receiving our newsletter and to be removed from our mailing list at any time; to do so, please contact us either in writing or by email (see contact details at the end of this notice).

Who is your personal data shared with?

We may disclose your data to our affiliated organisations and subsidiaries, and to service providers who render services to us or you on our behalf (all of which are contractually obligated to act only on our instructions and in accordance with applicable data protection laws, including GDPR). We may also disclose your information if required by law, requested by law enforcement authorities or to enforce our legal rights; for example, HMRC have the right to inspect our records for Tax and VAT compliance purposes.

Our website at https://thehearingspace.co.uk does not collect or process personal data in any automated way.

When you contact us through our website your details are not stored by the website; the details that you enter are simply processed by sending an email to us, the content of which is securely stored on our internal email system. We will only use the details you provide to us for the purpose of responding to your enquiry.

Cookies

A cookie is a small text file which asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We use traffic log cookies to identify which pages are being used. This helps us analyse data about web-page traffic and improve our website in order to tailor it to user’s needs. We only use this information for statistical analysis purposes and the data is then removed from the system.

Overall, cookies helps us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share.

Analytics

On our websites we use Google Analytics to track user behaviour. This information is collected anonymously. This service tracks how users find this website, information about the device used to visit our site and information about what pages are viewed and for how long. Additionally specific user behaviour on the site, such as links being clicked or images being viewed, can also be tracked. This information is used to help optimize our websites and improve the user experience.

Your rights

We recognise that your personal data belongs to you and we do our best to use it in ways that you are happy with.

You can control whether you receive marketing email from us by letting us know directly. You can either write to us or send us an email to: hello@thehearingspace.co.uk

You have certain rights under UK data protection legislation, including the option to:

  1. access your personal information – you will not be charged for this service
  2. rectify your personal information if it is inaccurate or incomplete
  3. erase your personal information and prevent further processing in specific circumstances and where there is no other lawful ground for continuing to retain and process that information.

  5. you have the right to restrict processing or block processing of your personal data
  6. you have right to data portability – allowing you to retain and reuse your personal data for your own purpose
  7. you have the right to object to your personal data being used. This includes, if you want to object us using your personal data for the purpose of direct marketing, scientific and historical research, or for the performance of a task in the public interest.
  8. you have the right of automated decision making and profiling – protecting you against the risk that a potentially damaging decision can be made without human intervention. For example, you can choose not to be the subject of a decision where the consequence has a legal bearing on them or is based on automated processing.

We will acknowledge any request regarding your rights and let you know the next steps. In most cases we will need to verify your identity before actioning your request.

The Hearing Space will acknowledge receipt of all complaints and endeavour to investigate the complaint within twenty working days.
